Welcome to artisanxtr.com (the “Site”), operated by Artisan XTR (“Artisan XTR,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

1. Using the Site

You may use the Site for lawful purposes only, including learning about our services and requesting a quote. You agree not to:

  • Misuse the Site or attempt to disrupt or gain unauthorized access to it
  • Submit false, misleading, or fraudulent information
  • Use the Site to send spam or unauthorized marketing
  • Copy, scrape, or redistribute Site content except as allowed by these Terms or with our written permission

We may change, suspend, or discontinue any part of the Site at any time.

2. Quotes and Estimates Are Not Contracts

Information on the Site, and any quote or estimate we provide through a form, phone call, email, text message, or in-person visit, is an estimate only unless you and Artisan XTR sign a separate written agreement.

  • Quotes and estimates are not binding contracts.
  • Pricing, timelines, product availability, and scope can change after a site inspection, measurements, material selection, or discovery of conditions not visible at the time of the estimate.
  • A project begins only when you and Artisan XTR sign a separate written contract, which controls over these Terms for that project.

Nothing on the Site is a guarantee of a specific result, price, or schedule.

3. SMS Program Terms

SMS Program. Artisan XTR offers text messages about quote requests, appointments, project updates, customer support and, if you separately opt in, promotions and seasonal offers. You opt in by checking the SMS consent box(es) on our website quote form. Consent is not a condition of purchase.

Frequency. Message frequency varies.

Cost. Message and data rates may apply. Contact your wireless carrier for plan details.

Opt-out. Reply STOP to any message to unsubscribe. You’ll get one confirmation message, and then no more messages unless you opt in again (reply START). Opting out of text messages does not cancel a project agreement you have already signed.

Help. Reply HELP, call 801-657-3573 or email info@artisanxtr.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy at https://artisanxtr.com/privacy-policy/. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

4. Intellectual Property

The Site and its content, including text, graphics, logos, images, layout, and design, are owned by Artisan XTR or our licensors and are protected by copyright, trademark, and other laws.

You may view and print pages from the Site for your personal, non-commercial use in evaluating our services. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission.

5. Third-Party Services and Links

The Site uses or links to third-party services (for example, our quote form and CRM tools, analytics, and social media profiles). Those services are governed by their own terms and privacy policies. We are not responsible for third-party sites or services.

6. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ARTISAN XTR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that content on the Site is complete or current. Site content is general information about our services and is not professional engineering, insurance, or legal advice. Warranties for work we perform, if any, are provided only in your signed project contract.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARTISAN XTR AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

These limits do not apply to liability that cannot be limited under Utah law. Your signed project contract may include different liability terms that apply to that work.

8. Indemnification

You agree to defend, indemnify, and hold harmless Artisan XTR and its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your submission of false information.

9. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. The state and federal courts located in Salt Lake County, Utah will have exclusive jurisdiction over disputes arising from these Terms or the Site.

10. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

11. Miscellaneous

  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce a provision is not a waiver.
  • These Terms, together with our Privacy Policy and any signed project contract, are the entire agreement between you and us regarding the Site.
  • A signed project contract controls over these Terms for that project.
